Residence authorization for real estate investment (CNIg Normative Resolution 36/2018)

Normative Resolution 36 of October 9, 2018 lets foreign individuals obtain residence by buying property in Brazil. The Consulate General in New York lists the minimums as BRL 700,000 for real estate in the North or Northeast regions and BRL 1,000,000 in the Center-West, Southeast or South. Since the 2024 amendment, the international transfer of capital must be confirmed by a declaration from an institution authorized or registered with the Central Bank of Brazil, covering either the purchase itself or a down payment under a promise of sale contract. Applicants still need prior authorization from the Ministry of Justice before seeking the VITEM IX visa.

Residence for executives of foreign-invested companies (CNIg Normative Resolution 11/2017)

Resolution 11/2017 serves administrators, managers, directors and executives with management powers who represent a foreign company, group or conglomerate investing in a Brazilian business. Investments made through a private equity fund (FIP) follow their own documentation list. The residence term is indefinite, but where the lower threshold was used, continued residence depends on proving the new jobs to the ministry.

Registration and fees

Every investor who receives residence must register with the Federal Police and obtain the Carteira de Registro Nacional Migratório (CRNM), the identity card for migrants in Brazil. The federal services portal lists BRL 168.13 for processing and assessing the residence authorization request and BRL 204.77 for issuing the CRNM, while scheduling and attending the Federal Police appointment carry no further charge. Consular visa fees are separate and depend on the consulate and nationality; the New York consulate, for example, lists USD 290 for US passport holders and USD 100 for other nationalities.

Questions and answers

How much real estate investment gives residence in Brazil?

Brazil's consular guidance lists BRL 700,000 for property in the North or Northeast regions and BRL 1,000,000 for property in the Center-West, Southeast or South. The transfer from abroad must be confirmed by an institution authorized or registered with the Central Bank of Brazil, and prior authorization from the Ministry of Justice comes before the visa.

Is the VITEM IX visa the same as residence in Brazil?

No. The VITEM IX is the temporary visa a consulate issues once the Ministry of Justice has granted prior residence authorization for an investment case. The residence itself is completed after arrival, when the investor registers with the Federal Police and receives the CRNM identity card for migrants.

Can a company executive qualify with less than BRL 600,000?

Yes, under Resolution 11/2017. Foreign direct investment of at least BRL 150,000 per executive is accepted if the company creates at least ten new jobs within two years of its installation or the executive's arrival. Continued residence then depends on proving those jobs to the Ministry of Justice and Public Security.
