Residence permit (permanent residence)

Status: Annual quota per nationality; applications only in announced windows

Thai permanent residence is issued as a residence permit under the immigration law. Applicants must hold a passport with a Non-Immigrant visa extended on a one-year basis for at least three consecutive years up to the application date, pass criminal checks if aged 14 or over, and understand and speak Thai. The Immigration Commission weighs income, assets, knowledge, professional expertise, family ties to Thai citizens, health and language ability. Applications are accepted only in periods the Immigration Bureau announces, and if eligible applicants from one nationality exceed the annual quota, places are shared out by category. Applicants file in person because fingerprints and an interview are required.

Where SMART S and LTR holders stand

Neither the SMART S rules nor the LTR program pages describe a direct path to permanent residence. The residence permit criteria refer to holders of a Non-Immigrant visa extended year by year for three consecutive years, so founders should ask the Immigration Bureau whether time on a SMART or LTR visa counts before relying on it. Because intakes depend on announcements and quotas, many long-term founders treat the renewable LTR visa as their practical base and view permanent residence as a discretionary later step.

Questions and answers

How many people can get Thai permanent residence each year?

The government sets a yearly quota per nationality, and when eligible applicants of one nationality exceed it, places are allocated by category. The figure is fixed by official announcement, so applicants should read the current notice from the Immigration Bureau before preparing documents.

Is Thai language ability required for permanent residence?

Yes. Published criteria state that the applicant must be able to understand and speak Thai, and the Immigration Commission considers language alongside income, assets, expertise and family ties. Applicants appear in person, which gives officials a direct chance to assess spoken Thai during the interview.

Can I apply for Thai permanent residence at any time?

No. Applications are accepted only during periods the Immigration Bureau announces. Applicants who miss a window wait for the next announcement and should keep their one-year non-immigrant extensions current so that the three-year history remains unbroken.
